If you got married in Thailand and have now registered your marriage then you can obtain your marriage certificate and apply for an Australian spouse visa in Bangkok. Note that it is best to apply for the correct Australian visa and not to apply for say an Australian Tourist Visa as Australian Immigration would not take too kindly to this and may view it as fraud.

Temporary Australian Spouse Visa

The Australian Spouse Visa for Thai is explained in more detail as well as what you will need to understand between the two Australian visas. This is the most common spouse visa as it allows you entry into Australia on a temporary basis allowing your Thai wife to live in Australia for 2 years before she can apply for a permanent spouse visa. She needs to collect all the Australian visa documents for this as well as meet all the requirements for this:

She has her Police Clearance Certificate in Bangkok

Your Thai wife will need to obtain a police clearance as part of the visa process. This takes a few weeks to obtain after she has been fingerprinted at Thai Special Branch police. This is part of all foreign visa processes. You will note that the Australian government will not allow someone with a criminal record to enter and stay in the country. If there are issues, then speak to us about the offence. 

Also she must have her health check and has a Health Certificate

The health check is also part of the process. She will need to show her vaccination certificates. Most times this will be in he home province. They are also blood tests and X-rays to check for TB and other illnesses. She is not allowed to open the medical report as the Embassy needs to open it.

She must be married to an Australian citizen

You will need to obtain your marriage certificate in Thailand from the Amphurs office where you registered the marriage. This will need to be translated into English and certified by the thai government. This you will need to add to your Australian marriage visa.

You need to be able to show you have an abode in Australia

You will need to show that you have accomodation in Australia. This can be home ownership or a rental agreement for your house or apartment. If you have a stepchild that is also going to Australia then you will need to ask if a bachelors flat will be accepted as accommodation. Talk to us online for more assistance and guidance. 

Also you need to show you meet the financial requirements (salary)

You will need to show that you meet the minimum standard as an income. See the Australia spouse visa checklist on this webiste. If you are not certain, then let us see if you qualify for the visa income requirements. Do you have equity in your home. do you have additional income. You will need to show your salary slip or bank account states if you are self employed. 

You must show a genuine relationship (photos and emails)

You will have to collect all your photos as well as letters and emails to show that you are a bonafide couple. This will be the largest part of your visa application in terms of documentation. All the photos, marriage and more to show that you are genuine. 

 

Permanent Australian Spouse Visa

The permanent Australian spouse visa allows your Thai wife all the benefits of the temporary spouse visa however she can apply for Australian citizenship once she arrives in Australia. To apply for this Australian visa she needs to meet the following requirements:

She has a Thai Police Clearance Certificate from Bangkok

Much like other visas your Thai wife will need to have a police clearance certificate. This takes a few weeks to complete after her fingerprints have been taken. Note that the Australian government will have an issue if she has a criminal record for murder or other violent crimes. Also, she must have a Health Certificate

The health certificate means that your Thai wife will need an X-Ray, blood tests as well as a check on her vaccinations. This medical report is sealed and the Embassy will open the report. Vaccinations she will normally find where she went to school. There is a format for this that we can assist you with.

She must be married to an Australian citizen

You will need to be an Australian citizen and you will need to obtain your marriage certificate where you registered your marriage in Thailand. The Amphur will give you a copy of both versions. This would need to be translated and then certified. You can then use this for proof of marriage.

You need to be able to show you have accommodation in Australia

You can show your apartment or homeownership. There is also a rental agreement to show that you have these. Note that they might look for a two-bedroom apartment if your stepchild is older. Speak to us or contact us about this. If you live with your parents then you will also need assistance with explaining the accommodation setup. Some ex-pats move back to a separate entrance on their parent’s property.

Show that you meet all financial requirements (salary)

You will need to show your income and your employment. This is a salary slip or your bank account if you are self-employed. You will need to show that you can afford to take care of yourself as well as your Thai spouse and/or child. See the financial requirements for the visa.

You must show a real relationship (photos and emails)

The largest part of your file is going to be letters, emails, and photos. This includes the child or children if you have any. Again talk to us about what will be needed to complete the view of the relationship. 

Also, you have been married for at least 3 years

This becomes very important as the marriage certificate will have to show that you have been married for at least 3 years. This is one of the important requirements for the permanent Australian spouse visa. If you have any children then see how this requirement can also change for the visa.

Married < 2 years but > 3 years but have a dependent child

If you have a dependent child then this will help with the visa process as you can see when it comes to time. Speak to us about this and explain why this is very important if you have not been married that long. This is one of the last requirements.
