Extradition

Firstly extradition from Thailand needs certain requirements. INTERPOL is located in France and was established in 1923 to ensure that there is cooperation between police forces around the world to cut down on transnational crimes. INTERPOL (International Criminal Police Organization) may even exist where there are no diplomatic relations between the countries. Extradition

There are a number of notices which can be issued by INTERPOL. These are as follows:

Red Notice: Firstly this is the same as an international arrest warrant and you will be arrested;

Blue Notice: Secondly this is a request for additional information on the person involved in a crime;

Green Notice: This is a warning that the person was involved in a crime and might do it again;

Yellow Notice: This is issued to find a missing person who might not know who he is;

Black Notice: This is issued to request information about unidentified bodies;

Orange Notice: Finally this is issued to warn other countries about concealed weapons and bomb threats.

Accordingly, once you get arrested, the other country who has issued the notice might want to extradite. Consequently, Thailand currently has extradition treaties with 14 countries for extradition. However that the extradition falls under the Extradition Act B.E. 2551 (2008). Finally they will also take into account the wording in the extradition treaties. The extradition has to fall outside of the following issues which has been highlighted below:

  • The offence is not political in nature;
  • The offence is not exclusively concerning the military;
  • Also the extradition does not violate other Thai laws;

Evidently the extradition request goes directly to the Attorney General in Thailand. This request must include the warrant for arrest, detailing all of the offenses.

Despite these must also include statement of facts and a statement of the maximum penalty. Equally many countries will not extradite where the person faces the death penalty.
