Material Evidence

Material evidence must be brought to court. If this isn’t possible, the court will inspect it at its location and record the findings appropriately. During proceedings, material evidence must be examined in front of the parties or witnesses.

Material Evidence in Court

Section 241

Anything that is used as material evidence must be brought to court. If it is not brought to court, the court shall visit the location where the material evidence is located. The court will inspect and record a report of the evidence in the place and by the method the court deems appropriate, considering the nature of the material evidence.

Section 242

During the investigation, inquiry into the cause of action, or consideration, items that are material evidence must be examined by the litigants or witnesses. If the packaging is altered or the seal is destroyed, new wrapping or branding must be done in the presence of the party or witness concerned.
